Variances

In certain situations, a literal enforcement of the provisions of the Zoning Ordinance will result in unnecessary hardship on a piece of property. In these cases a hearing before the Board of Adjustment (BOA) may be warranted as a means to provide relief for such hardships. A property hardship is one that is due to, and resulting from the shape, size, or terrain that exists on a piece of property. Financial or self-imposed hardships do not quality for variance consideration by the Board. All requests for a variance must be accompanied by:

  • A completed Board of Adjustment Application (PDF)
  • Two complete sets of project plans (24 by 36 inches) and one complete set of project plans (11 by 17 inches)
  • Electronic version of complete set of plans. Content and type of plans will be determined by staff after preliminary project review
  • $500 filing fee

Appeal of Decision from Community Development Department

Any person or persons wishing to appeal a decision or an order must file an application to the Board of Adjustment within 15 days of such decision. Such application must be accompanied by:

  • A signed and notarized description of alleged error in an order requirement, decision, or determination made in the administration of the Zoning Ordinance
  • If, in the event that plans or details supporting the appeal are to be referenced, 12 copies of such plans must be submitted
  • $500 filing fee
